Ep 019 “The pros & cons of using trusts for real estate”

In today’s episode, Tess from New York asks the question of what are the benefits of putting your home into a trust  and the pros & cons of doing so.

I’d like to start of this discussion with first saying there are several different type of trusts and used for many different types of reasons and advantages.

Let me first start off by explaining the basics of any trust and how they typically work informally.

The idea of a trust in general is to form a contract or set of agreements and instructions delegated by a grantor—the grantor is the person who wishes to give the instructions or duties to a third a party, usually a trustee—to be carried out in the event of something or an event happens or triggers the instructions in the future. When this event happens the agreements are then carried out per the trust to a beneficiary of that trust. The beneficiary can be a living person, a charity or just about anything or anyone.

If your question is will a trust add some asset protection? The answer is it depends on the type of trust and how your estate is laid out. The better wat to protect yourself from liability is to incorporate umbrella insurance policies with trust together. But I will stick to the specifics of trusts for this episode.

I am going to speak to the general form of a living trust because that is what most of the listeners are probably familiar with or most attorneys default to when discussing trusts for your home. These are also sometimes called family living trusts as well.

So let me explain what a living trust is:

Created while the homeowner is still alive, these are set up as revocable trusts, permitting the grantors, also often the trustees and beneficiaries, to change the terms of the trust or dissolve it entirely. The trust takes title to the home and transfers control of the property to the trustee. When the grantor dies, the trust becomes an irrevocable trust, prohibiting future changes to the terms.

– a living trust is where you transfer title to your major assets, such as home, cars, stocks and bonds, mutual funds, boat, RV, bank accounts and other significant assets into a living trust, which then holds the title. It is completely revocable at any time.

At the beginning, you (and your “significant other,” if you have one) are the trustor or often called the grantor, which simply just means you are the(creator of the trust), you are often the  trustee (manager of the living trust) and beneficiary (person who benefits from the trust). In other words, you continue buying, selling, holding and managing your assets just as before you put their title into your living trust.

When you (or your “significant other”) die or become incapacitated, the terms of the living trust become operative. If you are unable to manage your affairs, the alternate trustee (such as an adult child, trusted friend or attorney you can trust) already named in the trust document takes over management of the trust assets until the other party dies, assuming you had a spouse or significant other.

Upon the death of the trustor, if the living trust terms specify that all your assets are to go to your surviving spouse, or perhaps your favorite charity, that happens automatically without any probate court costs or delays.

One important thing I want to point out here is that if you have just your home in a living trust or family living trust that will be the only asset that passes through without probate.

It is important that you speak with a qualified estate planner for your specific situation.  if you have additional assets such as a business or other properties, stocks, or large bank accounts, etc these need to be included in your trust in order to pass through without additional probate proceedings.

The Conclusion to all of this is… Living trust advantages far outweigh any disadvantages or inconveniences. However, attorneys who specialize in probates will often discourage creation of a living trust.  Or make a mountain out of a molehill to increase their fees. So just make sure you don’t visit the law offices of Dewy Cheatum and Howe!

Ep 018 Motivation! How to grind it out, after a hard day’s work?

In today’s episode Fred asks how to keep himself motivated on his business after working all day?

After a long, hard day at work, the last thing many of us want to do is go home, buckle down, and go to work on something else. It can be tempting to just fall down on the couch, order a pizza, and then stumble off to bed, but doing that means you never use your free time to learn a new language, read a good book, start your own side hustle, or work on any of the personal projects that you’re passionate about. So how do you resist the temptation to do nothing when you’re not working?

You’ve worked a long hard day at work, and you’re finally free. It’s tempting to go home, and do nothing for the rest of the night, but after work is prime time to get started on your side project, do some forward learning, or do something else that you have a passion for. So how do you resist the urge to just relax on the couch after work every day? How do you find the motivation to stay productive after leaving work?

Inspired by the outcome of whatever it is you’re passionate about is the way to get it done. If you focus on the journey to getting it done and the small accomplishments.  That is what it’s about. That creates the momentum. Compounding the little strides and pieces to look towards the horizon and a bigger outcome!

The important thing here is that you make yourself accountable for a minimum dose that is effect for you and get things started and even on those nights when you don’t feel like doing anything, You know at least an hour of progress is compounding towards your goal. Remember you are only cheating yourself by not holding yourself accountable

The idea is to always keep your eye on the prize. No matter how much you stumble. And always keep clarity and momentum on your side to keep your motivation. Accountability that is measurable will keep your from going off the rails and reinforcement and environment will keep you engaged for sustainability!

Ep 017 “How to avoid paying too much in taxes with your side hustle”

In today’s episode Laura asks the question of how and when is it worth or not to have a side hustle and avoid paying all those new taxes.

This is a great question, but I think the bigger question comes from within as to what do you want to accomplish with your side hustle or freelance work?

You see the reality is for most of us we just use money as a conduit for a means to an end.  Either consumption, necessities or investment.

So I want to start this episode off with two things, one is, there, at least as of yet, no such thing as 100% tax. So no matter how much you make, you should have something left over.

Although we will have to see what the election cycle in November brings. If the wrong troops take over the legislative branch, those who plan on being in the 1% or even the top 10% could really be in for some serious tithing. Meaning taxes.

I am going to go off topic on this subject for a moment. I don’t care what you affiliation to politics is or are. And I don’t care who you vote for.  But I can’t help but cringe when I hear people talk about how the rich or wealthy don’t pay their fair share.

I believe we all have the same opportunities. I am not saying we all have the same skillset or upbringing or people who live in the ghetto have the same access to schools and outcomes. All I am saying is we all have the same set of rules in which we can play the game. One thing, I know from experience is the game is not always fair, but it does have only one set of rules.

That said, the thing that makes cringe is that even in investments, just like in taxes. People get off the signal and only hear the noise of percentages! What do I mean by that? I mean that people think in terms of percentages instead of the sum in actual dollars.

And when you do that, in investment and hear somebody say I made a 100% on my investment or money. That doesn’t equate to a whole lot if you only invested $10.00 and now you have a 100% return on that investment or $20.00 dollars.

Or if your business in year one sold one lollipop and sales grew by a 100% in year two, selling just 2 lollipops.

And as I always tell people who don’t take chances a 100% of nothing is nothing, You get the point!

So when somebody says the rich don’t pay their fair share, next time instead of listening to the noise produced by the hype and the media. Ask how much is that percentage in dollars? A quick math equation of a millionaire earning a million dollars per year and only paying a tax rate of 20% is 200,000 dollars in volume paid out in real money to the IRS.

And a person who makes a 100k a year but paying a higher 35% tax bracket is paying actually $35,000 dollars in volume in taxes.  So I pose the question or thought to you as to who is actually paying their fair share? Is the person paying in 200k dollars spreading more wealth through taxes or the person paying $35k the one? Sometimes you have to see through the white noise.

Remember, your perspective creates reality; it’s up to you to decide. I am only suggesting you listen always to signal and not noise in your discovery and path to wealth.

We’ve all heard that death and taxes are inevitable. Well, with all the biohacking and advances of technology in health, prolonged life may be soon a short reality, but taxes on the other hand are always inevitable depending on how you roll. With some tax planning, you can legally and ethically owe less money in taxes at the end of the year.

In the world of sustainable wealth we say, pigs love pals. And what that means is; pigs is an acronym for passive income generators and pals is an acronym for passive accumulative losses.

So let’s look at some ways to do just that, here are some steps you can take to reduce your taxable income and the taxes you will owe. These are basic tax-saving strategies that every taxpayer should know. Whether this income is from a side hustle or just plain income from your 9 to 5 or 9 to 9 job you have.

These strategies don’t involve offshore bank accounts or illegally laundering money through convoluted tax shelters. These tax planning devices are for you to understand and put to use, and are most likely to save you — the average taxpayer —  more money.
